Terms of Service

Welcome to Mythio. Mythio is an independently operated digital service based in India that provides audio documentaries through the Mythio mobile application. We also operate the informational website getmythio.com.

These Terms of Service govern your access to and use of the Mythio mobile application, website, audio documentaries, subscriptions, and related services, collectively referred to as the "Service".

By creating an account, purchasing a subscription, accessing content, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use Mythio.

1. Eligibility

You must be at least 13 years old to create a Mythio account. If you are under the age at which you can independently enter into a binding agreement in your country, you may use Mythio only with the permission of a parent or legal guardian where required by applicable law.

You must provide an accurate date of birth. Mythio may use your age to restrict access to content that is not considered appropriate for your age.

By using Mythio, you confirm that you meet these eligibility requirements and are legally permitted to use the Service in your country.

2. Your Account

You must create an account using your name, email address, date of birth, and password to access the Mythio app.

You agree to provide accurate and current information and to keep your account information updated. You are responsible for keeping your password confidential and for activity that occurs through your account.

If you believe your account has been accessed or used without your permission, contact us promptly at support@getmythio.com.

You may not create an account using another person's identity, transfer your account to another person, share login credentials for commercial purposes, or use another person's account without permission.

3. The Mythio Service

Mythio provides access to audio documentaries and related information. Some content may be available without payment, while other content or features may require an active subscription.

Mythio content is provided for general informational, educational, and entertainment purposes. It is not intended to replace professional medical, legal, financial, psychological, or other specialist advice.

While we aim to research and present our content carefully, historical accounts, scientific knowledge, interpretations, and other information may change, be incomplete, or be disputed. We do not guarantee that every statement will always be complete, current, or free from error.

4. Licence to Use Mythio

Subject to these Terms, Mythio grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable licence to access and use the Service and its content for your personal and non-commercial use.

Purchasing a subscription gives you access to eligible content during the applicable subscription period. It does not transfer ownership of any documentary, recording, script, image, design, software, or other material to you.

5. Intellectual Property Rights

Unless otherwise stated, Mythio or its licensors own all rights, title, and interest in the Service, including its audio documentaries, scripts, recordings, artwork, written content, branding, logos, software, interface, designs, and other materials.

These materials are protected by copyright, trademark, and other intellectual-property laws. All rights not expressly granted under these Terms are reserved.

6. Acceptable Use

You must not:

• Copy, record, reproduce, republish, upload, broadcast, or redistribute Mythio content;
• Sell, rent, sublicense, or commercially exploit the Service or its content;
• Share paid content or subscription access with unauthorised users;
• Download or store content except through an authorised feature provided by Mythio;
• Remove copyright, trademark, or ownership notices;
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the app;
• Scrape, crawl, data mine, or use automated systems to access or extract information from Mythio;
• Circumvent subscription controls, age restrictions, access controls, or security measures;
• Introduce viruses, malicious code, or other harmful technology;
• Interfere with the operation, availability, performance, or security of the Service;
• Use Mythio unlawfully, fraudulently, or in a way that infringes another person's rights;
• Use the Service or its content to develop, train, or improve an artificial-intelligence or machine-learning system without our written permission;
• Misrepresent your identity, age, account ownership, or subscription status.

7. Subscriptions

Mythio may offer automatically renewing subscriptions that provide access to paid content or features. Available plans, billing periods, prices, currencies, and included benefits will be displayed before you confirm a purchase.

Subscriptions purchased through the iOS app are billed through your Apple App Store account. Subscriptions purchased through the Android app are billed through your Google Play account.

Unless cancelled before the applicable renewal date, an automatically renewing subscription will renew for another billing period, and the relevant app store will charge the payment method connected to your store account.

Prices may vary by country, currency, taxes, app store, and subscription plan. The price displayed by the applicable app store when you confirm the purchase is the price that applies to that transaction.

Mythio uses RevenueCat to verify purchases, maintain subscription status, restore purchases, and determine access to paid content.

8. Cancellation and Refunds

You can manage or cancel your subscription through the subscription settings of the Apple App Store or Google Play account used to make the purchase.

Cancellation generally takes effect at the end of the current paid subscription period unless the applicable app store or law provides otherwise. You may continue to access the applicable subscription benefits until that period ends.

Refund eligibility and refund requests are governed by the policies of the Apple App Store or Google Play and any rights available under applicable law. Mythio does not directly process your payment method or issue app-store refunds.

Deleting the Mythio app or deleting your Mythio account does not automatically cancel an active subscription. You must cancel the subscription separately through the applicable app store.

9. Changes to Subscription Plans and Prices

We may introduce, change, or discontinue subscription plans and benefits. Any price change affecting an existing subscription will be handled through the applicable app store and will take effect in accordance with the store's requirements and applicable law.

Where required, you will be notified of a price change and may be asked to approve it before your subscription continues at the new price.

10. Ratings and Feedback

Mythio may allow you to submit ratings, suggestions, support messages, or other feedback. These features do not permit users to publicly upload or publish content through Mythio.

You retain any rights you have in feedback you submit. By submitting feedback, you grant Mythio a non-exclusive, worldwide, royalty-free licence to use, reproduce, and adapt that feedback for operating, supporting, and improving the Service.

You should not include confidential information, unlawful material, or another person's personal information in feedback or support communications.

11. Notifications

Mythio may send service-related notifications and alerts about new or relevant Mythio content. Mythio does not send third-party advertising through app notifications.

You can disable notifications through your device settings. Disabling notifications will not affect your ability to access the Service.

12. Third-Party Services

Mythio relies on third-party services, including Google Firebase, RevenueCat, the Apple App Store, and Google Play. Your use of those services may also be governed by their own terms and policies.

We are not responsible for third-party services, payment systems, websites, or platforms that we do not own or control. Problems relating specifically to an app-store account or payment method may need to be resolved directly with Apple or Google.

13. Privacy

Our collection and use of personal information are described in the Mythio Privacy Policy. By using the Service, you acknowledge that your information will be handled as described in that policy.

14. Service Availability and Changes

We aim to keep Mythio available and functional, but we do not guarantee that the Service will always be uninterrupted, secure, or error-free.

Mythio may be temporarily unavailable because of maintenance, technical issues, security incidents, service-provider outages, legal requirements, or circumstances outside our reasonable control.

We may update, modify, replace, or discontinue features or content. The availability of a particular documentary may change because of licensing, editorial, technical, or legal reasons.

Where reasonably practicable, we will provide notice before making a material change that significantly affects an active paid subscription.

15. Suspension and Termination

We may restrict, suspend, or terminate your account or access to the Service if we reasonably believe that:

• You have materially or repeatedly violated these Terms;
• Your account is being used fraudulently or without authorisation;
• Your activity creates a security, legal, or operational risk;
• Suspension or termination is required by law or a competent authority;
• Payment for an applicable subscription has been cancelled, reversed, or refunded.

Where appropriate and legally permitted, we may notify you and provide an opportunity to address the issue before terminating your account.

You may request deletion of your account through the Account section of the Mythio app or by emailing support@getmythio.com from your registered email address. Account-deletion requests are reviewed and ordinarily completed within 30 days.

Account deletion does not cancel an active subscription. Provisions relating to intellectual property, payments, liability, and disputes will continue to apply where their nature requires them to survive termination.

16. Disclaimers

To the maximum extent permitted by applicable law, Mythio is provided on an "as is" and "as available" basis. We do not guarantee that the Service will always be available, free from errors, or suitable for every user's individual requirements.

Nothing in these Terms excludes any warranty, guarantee, or consumer right that cannot legally be excluded or limited.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Mythio will not be liable for indirect, incidental, special, consequential, or punitive losses arising from your use of or inability to use the Service, including loss of data, opportunity, business, or anticipated savings.

Mythio is not responsible for losses caused by your failure to protect your login credentials, third-party platforms outside our control, incompatible devices, internet failures, or unauthorised modifications to the app.

Where liability cannot be excluded, our total liability relating to the Service will not exceed the amount you paid for Mythio during the 12 months immediately preceding the event giving rise to the claim, except where a different remedy or amount is required by applicable law.

Nothing in these Terms limits liability for fraud, wilful misconduct, or any other liability that cannot legally be excluded or restricted.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify Mythio against third-party claims, losses, or reasonable expenses directly resulting from your unlawful use of the Service, infringement of another person's rights, or material violation of these Terms.

This section does not apply to the extent that a claim or loss was caused by Mythio's own unlawful conduct or negligence.

19. Consumer Rights

These Terms do not exclude, restrict, or replace any mandatory rights or remedies available to you under applicable consumer-protection law.

Where any part of these Terms conflicts with a mandatory legal right, the applicable law will prevail to the extent of that conflict.

20. Changes to These Terms

We may update these Terms to reflect changes to Mythio, subscription offerings, third-party services, or legal requirements. The revised date will be displayed at the top of this page.

If a change materially affects your rights or use of the Service, we may provide additional notice through the app or the email address connected to your account.

Your continued use of Mythio after updated Terms take effect constitutes acceptance of the updated Terms, except where applicable law requires a different form of consent.

21. Assignment

You may not transfer your account or your rights under these Terms without our prior written permission.

We may transfer our rights and obligations as part of a reorganisation, incorporation, merger, acquisition, sale of the Service, or transfer to a successor operator. Where required by law, we will provide notice of such a transfer.

22. General

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be modified to the minimum extent necessary or treated as removed. The remaining provisions will continue in effect.

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived the right to enforce it later.

These Terms, together with the Privacy Policy and any purchase terms displayed by the applicable app store, form the agreement between you and Mythio concerning the Service and replace prior agreements or representations concerning the same subject.

23. Governing Law and Disputes

These Terms are governed by the laws of India, without limiting any mandatory rights you may have under the laws of the country in which you live.

Before starting formal proceedings, you are encouraged to contact us so that we can attempt to resolve the dispute informally.

Any dispute that cannot be resolved informally will be subject to the jurisdiction of the courts or consumer forums having lawful authority under applicable law. Nothing in these Terms prevents you from approaching a consumer commission, regulator, or other authority where you are legally entitled to do so.
